1. Definitions

For the purposes of these Terms of Service, the following definitions apply:

• Platform: The website, software application, dashboards, and online workspace hosted at inkvisel.com and related subdomains.
• Service: The digital compilations, idea validation tools, outline generation engines, and AI-assisted writing modules provided by InkVisel.
• User: Any individual, writer, self-publisher, or organization who accesses the Platform or registers an Account.
• Account: The secure, authenticated profile created by a User to log in and access Platform features.
• Content: Any prompts, input texts, voice snapshot guidelines, uploaded reference documents, or materials submitted by a User.
• Generated Content: The text drafts, outlines, compiled book chapters, planner grids, and promotional copy generated by the Platform's AI processors.
• Subscription: The paid commercial service plan selected by a User to access premium tools and credit limits.
• Credits: The digital utility balances used on the Platform to execute co-writing operations, validating ideas, and formatting exports.

2. Account Access & License

To use our Platform, you must meet our eligibility requirements and secure your account access:

• Eligibility: You represent that you are at least 18 years of age (or the legal age of majority in your jurisdiction) and possess the full legal authority to enter into these Terms.
• Account Registration: You must register an account by providing accurate, current, and complete details. You agree to update this information to maintain its accuracy.
• Account Security: You are solely responsible for safeguarding your login credentials, password, and security tokens. You must immediately notify us of any unauthorized use or security breaches.
• Personal Use & Restrictions: Accounts are granted for personal or authorized business use only. You may not share your account credentials, login links, or security tokens with third parties.
• Limited License Grant: Subject to compliance with these Terms, InkVisel grants you a limited, non-exclusive, non-transferable, revocable, and non-sublicensable license to access and use the Platform and Services for your personal or internal business operations.

To ensure compliance and accuracy, please note:

• AI outputs may contain errors, hallucinations, or outdated information.
• You should thoroughly review, edit, and fact-check all AI-generated content before publishing or distributing it.
• Users are responsible for independently reviewing AI-generated outputs before relying on them for legal, financial, medical, regulatory, or other high-impact decisions.
• InkVisel does not warrant or represent the factual accuracy, legality, originality, safety, or suitability of any Generated Content.
• You remain solely responsible for the content you publish, distribute, or use commercially, including verifying that it does not violate third-party copyright, trademark, or publication platform guidelines (such as Amazon KDP, Etsy, or Gumroad).

5. Acceptable Use

You agree not to use the Platform or Services to perform or facilitate any prohibited activities, including:

• Performing any illegal activity or violating local, national, or international laws.
• Distributing or uploading malware, viruses, Trojan horses, or other destructive software.
• Creating phishing campaigns, fraudulent schemes, or deceptive materials.
• Generating or sending unsolicited spam, automated mass messages, or bulk marketing list files.
• Infringing upon copyrights, trademarks, patents, or other intellectual property rights.
• Reverse engineering, decompiling, or trying to extract the source code of the Platform.
• Utilizing automated scrapers, web spiders, or crawlers to extract content or page data.
• Sharing your account credentials or login information with other individuals.
• Abusing our APIs or the secure AI model gateway infrastructure.
• Attempting to bypass, disable, or circumvent platform security measures or access controls.
• Submitting excessive automated requests that place an unreasonable load on our servers.
• Violating the privacy, publicity, or contract rights of third parties.

6. Subscriptions & Billing

Our service offerings are governed by the following subscription and billing terms:

• Subscription Plans: Users may select from various paid tiers which grant specific credit limits and premium workspace features.
• Secure Payment Processing: All billing actions, credit purchases, and invoices are handled securely through our merchant of record, Dodo Payments.
• Automatic Renewal: If automatic renewal is enabled in production and selected in your billing configuration, your subscription will automatically renew at the end of each billing cycle using your chosen payment method.
• Taxes: Subscription fees are exclusive of applicable taxes, VAT, or digital sales taxes, which will be calculated and added where applicable during checkout.
• User Billing Responsibility: You agree to maintain accurate, updated, and complete billing information.
• Cancellation Process: You may cancel your subscription at any time through your account billing settings. The cancellation will take effect at the end of your current billing period.
• Refund Policy: All refund requests, credit refund conditions, and payment cancellation terms are governed exclusively by our separate Refund Policy.

7. Account Termination

We reserve the right to manage account access to maintain platform security:

• Suspension or Termination: InkVisel may suspend or terminate your account and block access to the Platform for terms violations, suspected fraudulent activity, security threats to our servers, illegal use, or system abuse.
• Account Deletion: You may request the deletion of your account at any time. Account deletion is subject to any ongoing legal, tax, or billing obligations (such as outstanding payments or compliance records).

8. Service Availability

While we use reasonable efforts to maintain server availability:

• Features, interface options, credit allocations, and AI model configurations may change or be retired.
• We may regularly update the Platform, run database operations, or perform system maintenance.
• Temporary downtime or service interruptions may occur. We do not promise uninterrupted or error-free service availability.

9. Third-Party Services

InkVisel relies on trusted third-party providers to deliver services, including:

• OpenRouter: For routing prompt queries securely to selected AI models.
• Dodo Payments: For secure checkout, tax processing, and subscription management.
• Cloud Infrastructure Providers: For hosting our databases and web application servers.
• Analytics Providers: For tracking usage data and marketing performance.

Users should review the applicable terms and privacy policies of these third-party providers. InkVisel is not responsible for the availability, security, or functionality of third-party services beyond its reasonable control. 10. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall InkVisel, its founders, affiliates, or service providers be liable for any indirect, incidental, consequential, special, or punitive damages. This includes, without limitation, loss of profits, business interruption, loss of data, errors or inaccuracies in AI-generated outputs, database downtime, or failures of third-party services. Nothing in these Terms attempts to exclude or limit liability where prohibited by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless InkVisel, its founders, affiliates, and service providers from and against any third-party claims, legal actions, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in connection with:

• Your misuse of the Platform or Services.
• Your violation of these Terms.
• Your infringement of third-party rights, including copyright, trademark, or privacy rights.
• The publication, sale, or distribution of your Generated Content on digital marketplaces.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat, India, unless otherwise required by applicable consumer protection laws in your jurisdiction. Nothing in these Terms limits any non-waivable consumer rights available under applicable law.

13. Changes to these Terms

We may update these Terms from time to time to reflect operational, legal, or security changes. When we make updates, we will update the “Effective Date” and “Last Updated” fields at the top of this page. Your continued use of the Platform after the changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated terms, you must stop using the Platform.
